Family Sues After Teen Suspended for Saying “Illegal Aliens” in Class
A high school student from North Carolina has taken a stand against illegal immigration by suing his school district for violating his First and Fourteenth Amendment rights. Christian McGhee, a 16-year-old student at Central Davidson High School, was suspended for three days last month for using the term “illegal aliens.” McGhee’s story has gained national attention as he fights back against the school district’s decision to censure him for expressing his views.
The Liberty Justice Center, a non-profit litigation firm dedicated to protecting constitutional freedoms, announced on Tuesday that it was taking on McGhee’s case. According to the group, the incident that led to McGhee’s suspension occurred during a classroom discussion. When his teacher used the word “alien,” McGhee asked for clarification, asking if the term referred to “space aliens, or illegal aliens who need green cards?” Despite causing no disruption in class, school administrators determined that McGhee’s question constituted a “vicious racial slur” and suspended him for three days.
This swift disciplinary action against a student simply asking a question has sparked outrage and raised concerns about censorship on school campuses. The Liberty Justice Center’s lawsuit against the Davidson County Board of Education alleges that the board violated McGhee’s rights to free speech and due process by suspending him without allowing him to appeal the decision.
Buck Dougherty, an attorney with the firm, argued that by suspending McGhee, the school board violated his constitutional rights. Not only was the teen not allowed to appeal his suspension, but he was also subjected to bullying and threats upon returning to school. As a result, his parents pulled him out of the school, and he is now completing his semester through a homeschooling program.
